Provides that a person who is in the business of purchasing precious metal shall obtain a proof of ownership, create a record of the sale, and verify the identity of the seller. Provides that a person who is in the business of purchasing precious metal shall not pay for the precious metal in cash and shall >record the method of payment. Requires the purchaser to keep a record of the sale for one year or, if the purchase amount is over $500, for 5 years. Provides that a person who violates the Act is guilty of a petty offense and subject to a fine not exceeding $500. Provides that the Attorney General may inspect records, investigate an alleged violation, and take action to collect civil penalties.

If everyone will remember, a family who inherited a cache of antique gold coins had them confiscated by the feds recently as they were owned during that time of illegal personal gold coin ownership.

In the Progressive Republic that is Illinois, Republicans and Democrats are the same beast. There is no difference. In any case it appears this is directed towards wholesalers – people who are in the business of trading preceous metals.
You can try to explain it away, but the fact remains, the author of the bill is a Republican. Definitely not the same as a Democrat.

Upon further review the bill looks to be directed towards jewelry and pawn shops. Likely as a stop for stolen goods. State governments will sometimes pass laws requiring that payment be made by check or voucher for certain things.
However, the Constitution of the United States provides that "No State shall … make any Thing but gold and silver Coin a Tender in Payment of Debts." Article I, Section 10, Clause 1.
Here's how this works:
You hand ownership of your gold and silver ingots over to the dealer. The dealer now owns them and is indebted to you. The State of Illinois is mandating that that debt be paid by check or some method other than cash. Other states do similar things. For example, Connecticut law mandates the payment be by check, and that the check cannot be then cashed by the dealer that issued the check. Louisiana passed something similar in the last few years. These states are thus making something other than gold and silver coin legal tender (under state law) for the payment of debts. This is a violation of the US Constitution's Article I Section 10.
You bring a lawsuit seeking to strike down the state law. Notice, you're not attacking FEDERAL legal tender laws (that's another matter for another day), you're seeking to strike a STATE law that makes something besides gold and silver coin legal tender for the payment of debts.
In addition to the Constitutional issue, the state law in question also violates federal legal tender law. See 31 U.S. Code Sect. 5103. Federal law provides:
"United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues. Foreign gold or silver coins are not legal tender for debts. "
- Title 31, United States Code, Subtitle IV, Chapter 51, Subchapter I, Section 5103
Thus the state law also violates federal law, giving you an additional legal ground for attacking the validity of the state law in question.

Great point. In additiona I just read an article in Mises Daily regarding pork but in reality about big agra in general. One of the points was regarding the federally mandated "check off" programs for beef, pork and poultry for every animal taken to market. This check off tax then pays for the federal agencies and agra counsels that promote said beef, pork and poultry and I am sure a fair bit of beuracracy. In any case the Supremes in a 6-3 decision (Scalia holding for th majority) ruled the check offs to be consitutional because it involved government speech which is apparently different from individal free speech. So in effect the government can mandate a tax in order to engage in propaganda of any type. I am sure there is a "check off" coming for gold and silver purchases out there some where.
Good idea. However, with the enactment of the felonious Federal Reserve in 1913, the meat of this clause has been gutted. The fed.gov has enforced it on occasion against stores giving tokens, retailers accepting bullion payments and few State scams. But everyone had their Constitutional rights violates multiple times last year (do your own research). That's more than billion viable claims against a defendant with deep pockets. One only has to read lame stream media to get a handful of new additional claims. Breaking the law and violating citizen rights are two of the fed.gov's most pervasive outcomes. The States, on the other hand, violate citizens rights nearly every minute. Unfortunately federal law suits preceded by the appropriate state action are costly and time consuming. But suing the governments out of existence is a wonderful concept. Too bad lawyers are so gutless…

OK, I'm as suspicious as the next guy, but this clearly seems to be regarding people "in the business of purchasing precious metal" have to document the SELLERS of metal to them, not the buyers. Am I missing something? I would think that was intended to prevent pawn shop or coin dealer sales of precious metals from burglars, and prevents payment in cash. This looks like for SELLERS to PRECIOUS METAL BUSINESSES. Not that I'm for ANY additional government regulations, but someone please clarify this one for me. Am I wrong?

This bill failed to pass the House in the 97th General Assembly, which adjourned on Tuesday, Jan 8th. That's not to say it won't be reintroduced, but technically that bill is dead.
