Cop Tasers a 10-Year-Old for not Cleaning the Police Car

What would lead a police officer to do this?

We are taught that “all guns are loaded,” and therefore we are never to point a gun at anyone, then the same should apply to Tasers.

This should have been dealt with by the local police department: restitution for the boy paid for by the cop. It should not have gone to court.

 A New Mexico policeman Tasered a 10-year-old child on a playground because the boy refused to clean his patrol car, the boy claims in court.

Guardian ad litem Rachel Higgins sued the New Mexico Department of Public Safety and Motor Transportation Police Officer Chris Webb on behalf of the child, in Santa Fe County Court.

Higgins claims Webb used his Taser on the boy, R.D., during a May 4 “career day” visit to Tularosa New Mexico Intermediate School.

“Defendant Webb asked the boy, R.D., in a group of boys, who would like to clean his patrol unit,” the complaint states. “A number of boys said that they would. R.D., joking, said that he did not want to clean the patrol unit.

“Defendant Webb responded by pointing his Taser at R.D. and saying, ‘Let me show you what happens to people who do not listen to the police.'”

Webb then shot “two barbs into R.D.’s chest,” the complaint states.

“Both barbs penetrated the boy’s shirt, causing the device to deliver 50,000 volts into the boy’s body.

“Defendant Webb pulled the barbs out [of] the boy’s chest, causing scarring where the barbs had entered the boy’s skin that look like cigarette burns on the boy’s chest.

“The boy, who weighed less than 100 lbs., blacked out.

“Instead of calling emergency medical personnel, Officer Webb pulled out the barbs and took the boy to the school principal’s office,” the complaint states.

Higgins says the Tasing gave the boy post-traumatic stress syndrome, and that “The boy, R.D., has woken up in the middle of the night holding his chest, afraid he is never going to wake up again.”

She adds: “No reasonable officer confronting a situation where the need for force is at its lowest, on a playground with elementary age children, would have deployed the Taser in so reckless a manner as to cause physical and psychological injury.”

She seeks punitive damages for the boy for battery, failure to render emergency medical care, excessive force, unreasonable seizure, and negligent hiring, training, supervision and retention.

When the Tea Party was holding rally's, The participants totally cleaned up any and all trash. Not one arrest was ever made for any reason. Your Wall Street Occupier's broke laws constantly. Left huge mess's for what ever jurisdiction they were in to clean up. Broke windows of business's, detroyed property, people were robbed, beaten, raped, stabbed. The list goes on. That does not sound like a party that I would want to be involved with.

  7. Tasers were promoted to police departments across the country as a "non-lethal" way of subduing violent suspects, but they have killed 100's since they were introduced because if a cop tasers a suspect at the right moment in the heart's rhythmic cycle it stops and you die anyway.

    And a shaved-head, 200-pound+ porker with a badge must feel so butch when he tasers a 10-year-old kid, for godssakes.

  9. I am surprised and shocked that a law enforcement officer in NM would behave so badly…and thoroughly disgusted that he has not been fired for his callous act. I know that there are some cities and towns in NM where he would not be left on their police force; seens to me the State Troopers ought to be investigating the case since the local unit refuses to do anything about it. Hope the boy wins his case and is paid megabucks.

  10. You have to wonder why LEO still insists tasers are "non-lethal." Everyday, we hear of someone dying as a result of being 'tasered;' usually, the officer over uses the taser and that is why the death rate is so high.

    The taser was supposed to be the used when shouting didn't work and shooting wasn't possible. The effect was MORE yelling, MORE shooting, and now we have the added option of electro-shock.

    The propaganda is that a tazer is a non-lethal weapon.
    The demonstrations are always on a large, young, and obviously healthy male.
    There have been several reports of the lethality of this weapon when directed against an adult.
    Why is it even permissible for an ~~infernal device~~ [that is what the legal definition used to be for this sort of device] to be used against a child?
    The things need to be outlawed as police continue to demonstrate their inability to use the device appropriately.

How about the next demonstration reproduce real world conditions and have the target stand alone and let their skull rebound off the concrete. Then we can see how "safe" tasers are.

  28. The more you see and hear about today's police officers, the more you realize they're already operating in the communist mode. Even my 10-year-old granddaughter and her friends know that if they are having some kind of problem, NEVER go to a cop for help. Sad but true, the people that were once considered the "good" guys have now become the "bad" guys and need to be feared.

  33. Sorry Cora, this is exactly the kind of thing that needs to be put before the people (especially the ones out of the area who wouldn't normally see it). If people don't wake up to the brutality of those who are in positions of power, or authority, how will you even know what kind of person to put in office. We haven't been too good at it for a very long time, but things are so bad in so many sectors that knowledge and determination to restore solid, good thinking people at all levels of government is absolutely essential. Law enforcement has their share of bullies who throw their weight around, and more often with children than you would want to believe. This is as much about his superiors as about him, and shame on them for not dismissing him immediately. And even if they did that, this most certainly is cause for a lawsuit despite the comment leading into the article. This child was 10 years old for Pete's sake!

  38. I can only believe that he accidentally shot the kid, although that's no excuse. You don't point a weapon at a person unless you intend to shot him. Ditto with tasers. This reminds me of the undercover drug cop who accidentally shot himself in the foot while giving a lecture on gun safety to a group elementary school students. That's a must-see YouTube video.

  42. My daughter learned that lesson in high school. Has stated a number of times she will most likely never call the police for anything. My family and some friends have stated they will not answer any questions unless their lawyer is present.

    Hold on…I must be missing something…Did the article say the cop tased a boy for not cleaning his car? Doesn't even matter that it was a 10-year-old. Since when do cops anywhere in this country have the right to give orders, excerpt under limited circumstances? Sure, when they direct traffic, or are protecting a crime scene, or demanding ID, things like that, we're compelled to obey, but to clean their car? That can't be right. That had to be an error in reporting. As bad as some cops are, surely none of them believe they can compel anyone to clean their car.

  51. this is very much a political issue as cops more and more see themselves as having the right to suppress, threaten and control, rather than protect. More psychological testing is needed before we arm the thugs like this one and send them out there. One bad cop like this is not only a threat to civilians, he is a threat to the other officers who are doing their jobs. The truth is do we want a valid police force to protect us, or do we want hordes of SS, so this is about as political as you can get.
    I hope this kids gets such a huge award that former cop has to live in a tent the rest of his life.
