Spanking a Child Is a Felony in Delaware

It had to happen.

Delaware has become the very first state to pass a controversial law that effectively outlaws the corporal discipline of children by their parents. Senate bill 234 was signed into law by Governor Jack Markell on September 12.

Sponsored by Delaware’s Senate Majority Leader Patricia Blevins, the bill redefines child abuse laws to include any act that causes “pain.”

Now parents who cause pain will find themselves prosecuted. Consider the pain of a lawyer at $200 an hour, followed by a conviction.

“Assaults against children are different than assaults against adults,” said Sen. Blevins. “So, it is important to make this a standalone crime.”

The new law creates three levels of child abuse. The first and second degrees are considered felonies and penalties increase if the victim is under four years old and suffers from intellectual or developmental disabilities. Parents who are guilty of committing “physical injury,” or “pain,” to a child under the age of 18 would be guilty of a class A misdemeanor and subjected to a year in prison as a result. One who is charged with causing pain to a child under the age of three would be guilty of a class G felony and subjected to two years imprisonment.

Voters in the northeast will accept almost anything. They do not resist. They do not leave the state. They sit.

Liberty is now maintained by the tender mercies of politicians and bureaucrats.


Guess what?

Behind the push for this law was state Attorney General Beau Biden, the son of U.S. Vice President Joe Biden. “We know children are three times more likely to be assaulted, hurt or harmed if they have a developmental disability or are under four years old,” said Biden. “We wanted to recognize a very vulnerable victim pool.”

Spanking is child abuse.

Delaware State Rep. Rebecca Walker, who cosponsored the bill, explains that she feels very strongly about child abuse after she witnessed cases of abuse firsthand while working as a forensic emergency room nurse. “It happens a lot in Delaware, a lot more than people think,” said Walker. “[This bill] can be something that will help our kids be a little bit safer.”

There is of course liberal doublespeak.

Biden insists that the law does not prohibit spanking. “This will not do anything to interfere with a parent’s right or ability to parent as they see fit, but it also makes it clear that if you abuse a child in any way, shape or form, we’re going to have a statute that we’re going to be able to use to protect kids,” he stated.

Before spanking your child in Delaware, consult your lawyer . . . at $200 per hour.

. . . StopSpanking.org interpreted the ordinance to prohibit spanking, reporting on its site, “Delaware is the first state to legislate against hitting children in an effort to stop child abuse. Senate Bill 234 effectively bans hitting of children, including in the home.”

Tell me this is not nuts.

Nicole Theis uses the example of a child reaching for a boiling pot of water and this law making it so that you can’t slap its hand to defend spanking. There has to be a problem with someone when the first thing they can think of doing is hitting a child. How about pulling the hand away instead?

Corporal punishment doesn’t work in the long run. In places which use it alot also have a high incidence of abuse of the elderly.

Believe it or not, but this is merely more fall out from framer's failure to expressly establish the Constitution upon Yahweh's morality as codified in His perfect law and altogether righteous judgments (Psalm 19:7-11). This would not be occurring if instead they had done as America's 17th-century colonials did:

    "Their form of government was as strictly theocratical insomuch that it would be difficult to say where there was any civil authority among them distinct from ecclesiastical jurisdiction. Whenever a few of them settled a town, they immediately gathered themselves into a church; and their elders were magistrates, and their code of laws was the Pentateuch…. God was their King; and they regarded him as truly and literally so…." (William Holmes McGuffey, McGuffey’s Sixth Eclectic Reader (New York, NY: American Book Company, 1879) p. 225.)

    Not only did the framers fail to name, recognize, or credit Yahweh (the God of the Bible), His Son, or His law for anything, there is hardly an article or amendment that, in some fashion, is not antithetical, if not hostile, to His morality as found in His commandments, statutes, and judgments. And what has come of this sedition? Government-funded and promoted Infanticide and sodomy, polytheism, economic ruin, this Delaware law, and every other abomination rampant in America today.

    People are handing more and more of their rights over to the government.

    Having raised three boys pretty much on my own, I knew that I had to instill a disciplined approach to raising them. If I had had a daughter, the rules would have been the same. My sons knew that if they misbehaved they would be spanked. When they are made aware that punishment will follow misbehavior, you hardly ever have to spank. Knowing that you will follow through is enough. When they were young, like all children, they test their boundaries. It is up to parents to set the limit on those boundaries. My children were NEVER beaten. That is not what discipline is about. So many of today's children are being raised to believe that being self-centered is okay and doing their own thing without reservation is natural. Discipline is a dirty word when it should be the rule of the home. Teaching respect for other people, honoring America, believing in God, and learning as much as you can so you take care of yourself. These are the basic rules of raising children. Many parents abdicate after giving birth to a child. The government cannot do a better job of raising children.

    Again another states outlaws a parents right to discipline their children when they misbehave. The 'spare the rod, spoil the child" mindset does not work. And we wonder why we have so many unruly juvenile delinquents running wild today. Today's rule of thumb is for parents to do nothing in the way of disciplining out of control children, wait til they commit a crime, due to lack of child discipline ordered by the state, that way the state (CPS) can step in remove the child from the home, charge the parents as unfit parents, place the delinquents in state homes, where they become nothing more than "property of the state," where they can do what they want with them. Turning them into possibly hardened criminals. Some system. Another way for STATISM and the systematic destruction of the family unit.

  7. It's usually people who have NO kids, or have kids who are out of control misbehaving, who decide that spanking is wrong. What they fail to recognize is the difference between spankings and beatings. We spanked hands and swatted behinds until our kids were old enough to reason with, usually about age 4. Til then, they want what they want, and don't listen to reasons why they can't have it or do it. Once they begin to understand losing favorite toys, food, or activities as a consequence for misbehaving, you no longer need to spank, and none of our kids were spanked after about age 4, and none of our spankings were more than 1-2 swats on the hand or behind. But, an out of control 2 year old will nearly always grow up to be an out of control teen (sometimes they learn to be sneaky about it to avoid punishment). A mostly well-behaved 2 year old who knows better than to throw a tantrum in the grocery store will usually grow up to be a mostly well-behaved teen. And if your kid has a developmental delay, you aren't doing them any favors to let them misbehave without consequences – they'll really be handicapped then, because no one else will put up with the behavior you do.

    Guess LOVE is out the window, especially to the antiChrist system we have raising it's ugly head.

    As Christians we're to be God Like – He the perfect and ultimate law giver sets the examples to follow.
    How are we to learn Godly Judgment unless we APPLY Yah's standard?

    Proverbs 3:12: For whom the LORD loveth he correcteth; even as a father the son in whom he delighteth.

    Proverbs 13:24: Whoso is sparing his rod is hating his son, And whoso is loving him hath hastened him chastisement.

    Hebrews 12:6: For whom the Lord loveth he chasteneth, and scourgeth every son whom he receiveth.

    Isaiah 42:1: Behold my servant, whom I uphold; mine elect, in whom my soul delighteth; I have put my spirit upon him: he shall bring forth judgment to the Gentiles.

    Psalms 94:10: He that chastiseth the heathen, shall not he correct? he that teacheth man knowledge, shall not he know?

    I certainly would not stop correction of my children with physical force – no matter what man says.
    That said – if you properly administer righteous discipline, the child will even in stubborn children,
    will not go for long when the law is laid down & enforced – they will self guide themselves in short order.

    With the slippery definition in this law expect a stampede to the courthouse as angry 11 to 13 year olds accuse their parents of causing all kinds of "pain" through the normal process of growing up. The adults recognize the need for "guard rails" at this time of life being critical while the pre-teens are testing the boundaries and becoming frustrated that life does in fact have limits beyond which there are consequences.
    Let us also not forget about the "terrible twos" who throw a screaming fit when the rest of the world doesn't give them what they think they want, whether it is "good" for them, or even safe. This law will require that police be summoned every time a two year old throws a fit in a grocery store as the parents will have no ability to discipline these incipient monsters when they decide to have a public, loud, and violent meltdown.

    This is just the latest example of a government outlawing that which God specifically requires. "He that spareth his rod hateth his son: but he that loveth him chasteneth him betimes." (Proverbs 13:24). Did you get that? Refusing to spank or physically chastise one's son when he needs it is equated with HATING HIM. Indeed, if we love our children, we will use physical punishment as a tool to correct their bad behavior. God gives us this responsibility, and we must not fail to meet it, as parents. I strongly encourage any Christians in Delaware to heed the words of the Apostles: " Whether it be right in the sight of God to hearken unto you more than unto God, judge ye." (Acts 4:19B). TAKE A STAND, discipline your child in the manner God has commanded, irrespective of what the State says. God be with you as you do so. Amen.

  12. Spanking with your hand is a must. However, I don't believe in using objects like belts, paddles, baseball bats, etc. That is beating. However, spanking with your hand on the bottom does not cause injury. Just that little 'sting' to teach your child a lesson. Spoiled kids grow up to be too soft to deal with the reality of adult life and responsibilities, because they get used to getting what they want all the time. In reality, you don't always get what you want, but a disciplined child will grow up to accept not getting what they want. Also, they learn to be more caring of others, rather than selfish. There are too many selfish people in the world today. Soon, America will pay the price. Dollar devaluation/power grid failure, etc.

  13. Most homes where delinquency, discipline, failure and no future are a crushing problem in society are also homes where there is no intact nuclear family unit (unwed/divorced parent, serial boy/girlfriends in and out of the child's life).

    Plus a government-run education system that is the scandal of the civilized world, where kids are "diagnosed" as ADD so they can be drugged into a stupor until it's time to promote them up the line to a graduation where they can't read their own diplomas (if they don't turn senior year in jail or knocked up/unwed like everyone else in their socio-economic class).

    There is no substitute for a loving caring mother and father raising their children without day-care and putting the child's welfare first, at least for the first 18 years of life. Enforcing rules and boundaries without corporal punishment can be done, but American society has slid so far down the scale it's impossible to reason with most adults on the subject.

    Very well said. Now let's take it a step further.

    What most people don't understand is the children they think are theirs, are not. They belong to the state because most people gave their children away via 1. By applying for and obtaining from a god (the state) a marriage license (Go to any law dictionary and look up the definition of "License": "Permission to do that which, without said license, is a unlawful, a tort or a trespass." — Why do you think the sodomites want to be able to get a "license" for same sex "marriage" ???? — because IT'S UNLAWFUL and punishable by death under God's Law ! Leviticus 18 defines unlawful unions), thereby creating what is defined in law as a "partnership" or "limited business partnership" that can be regulated by the 3rd. party – the state. (See Corpus Juris Secundum), who owns the "issue" (children) of that licensed marriage (i.e., wards of the state). The "man & wife" respective authority's over "the issue" have been reduced to the equivalent of "baby sitters" via the now 3 party contract.

    And then 2. Solidified the "giveaway" via applying for and obtaining a birth certificate. Remember ? It went first to the "Register of Deeds" (you know, where "property" is recorded), which in turn forwarded it to the "State Division of Vital Statistics", who then sent it to and registered that child with The U.S. Department of Commerce. Now the future "tax paying ability" of that child is collateral for any and all loans the Federal Government chooses to take.

    Now, I understand this was not what most people intended when they got the respective licenses and certificates, but that's what happened. And yes, it amounts to fraud and/or constructive fraud. There are remedies, but one must first recognize the problem.

    And the real underlying problem is we as a "nation" (by the way, look up the definition of that word in an older dictionary, e.g., Webster's 1828. It doesn't necessarily mean "country".) have turned our back on our God, the God of Abraham, Isaac & Jacob, i.e., of the Bible, and have gone after and obeyed other gods (e.g., the state – The god that is served/obeyed is the god that is worshiped). The main one we went after in 1787 is "We The People" and took the power of making laws via state and federal legislatures, a power that belongs to God Almighty Himself and He alone!

    The only solution is to turn back to Him and His Perfect Moral Law via full immersion into Christ for the remission of sins (Law Breaking) and adherence to and enforcement of under The New Covenant.
