Church Must Marry Lesbians, Says Civil Rights Bureaucracy

Two lesbians asked to be married in a church-owned camp meeting. The church refused. The lesbians bought charges in the state’s department of civil rights. The department hauled the church into court.

It was a very special kind of court. It was not part of the judiciary. It was part of the executive — the same branch of government that enforces its interpretations of laws passed by the legislature.

There was no jury. It was not required. Remember, it was not part of the judicial branch.

Have you heard the phrase administrative law judge? This is a very special kind of judge. It is a judge who tries you on behalf of the branch of government that enforces the law. No jury required.

You didn’t know that? It’s time you learned.

The church was defended by a privately funded public legal organization, the Alliance Defense Fund. He argued:

“The government should not be able to force a private Christian organization to use its property in a way that would violate its own religious beliefs. Religious groups have the right to use their private property in a way that is consistent with their beliefs. That right, protected by both the New Jersey and U.S. constitutions, obviously trumps any law enacted by the state’s legislature.

“Through these events, the association connects with people who might not attend its worship services and encourages them to attend those services in the future. For example, the association begins its Saturday-night family entertainment events with a brief prayer and typically a quick promotion of its upcoming religious services and events. These are just some of the diverse ways that the association strives, in all its programs, to reach the entire community with the love and Gospel message of Jesus Christ.”

This did not persuade Administrative law judge Solomon Metzger, who ruled that Ocean Grove in fact had violated the civil rights of the lesbian couple. In his decision, he wrote,

“The respondent violated the [Law Against Discrimination] when it refused to conduct a civil-union ceremony for Ms. Bernstein and Ms. Paster. Respondent opposes same-sex unions as a matter of religious belief, and in 2007 found itself on the wrong side of recent changes in the law…

“As a religious organization that deems same-gender unions sinful, respondent is loath to be associated with such ceremonies and maintains that compelling this through the LAD violates its right of expressive association, free speech and free exercise of religion.

It got worse.

Not only did Metzger rule against Ocean Grove, but the association also lost part of the tax exempt status for that part of the property where the open air pavilion is located.

Churches are under fire. This will increase.

Some churches teach that Christians should not get involved in politics. I have news from them. So does Solomon Metzger.

    What next?? Au'naturalists (nudists) demanding to use ANY church property (not just this particular church) to 'sun bathe?' Don't snicker thinking I am being cynical, I think this ruling could be extrapolated to something like that or worse (i.e. a human marrying an animal?) More signs the apocalypse is near…..very near.

  5. Since when have the courts been endowed with the power to MAKE their own rules rather than just interpreting and enforcing those already on the books? Most likely under Obama, since it's merely another of his never-ending unConstitutional practices. The entire USA has been turned 180 degrees upside down by our illegal muslim POTUS. As things exist now, we might just as well abolish the US altogether and start over from square one. No anarchists, tyrants, or freedom-haters need apply for any political offices from president to janitor, and EVERYBODY needs to be vetted without exception. This sure isn't the country most of us grew up in, and I for one want the old America back. This new America has become way too crooked and underhanded to allow to exist.

  6. This kind of ruling will cause many who oppose christianity to come into churches with the motive of attacking the church along similar lines. This has been happening in Canada and other countries already. I knew it was only a matter of time until it got here. Actup and others are into this sort of thing. My contention would be that all tax exempt laws for churches should be stricken down and removed. That way, no church is beholden to the government on what they can and can't say. Freedom of religion would be restored to the churches. White churches would then be able to make political statements from the pulpit if they wanted to much like black churches can do already without fear of reprisal.

  7. Well, it appears to be the law in NJ. For that reason, the two "whatever ya wanna call them" should have seeked out a public official who can do marriages and leave the church alone. But, no, they wanted to seek the notoriaty of messin' with a church. Well, what the heck!! Hell needs some fresh coal stokers to keep the fires burning. May they forever rest in burning flames!!!!

  9. Don't give in to such stupidity, stand for what your church and their congregation stands for. The government should stay out of the Church and their belief, and don't impose their ignorant and hidious garbage on their belief. Stand firm and don't cave to their garbage. God will be proud!

  10. The church should stand up for its beliefs and say, "Hell no!" I wouldn't bow to a judge's ruling that was against my beliefs! He has no authority over that church and what God has ordained marriage to be, between a man and a woman! That judge could kiss my behind, and I'd tell him so to his face!


    I have been friends with gay people for 55 years and THEY ARE NOTHING LIKE THIS RADICAL MINORITY.



  12. I wonder how many people are aware that a marriage license was created so that an interracial marriage would be permitted? God never said that a man and a woman need a license to be called married and go forth and multiply.

    Where did this so called court come from and where does it get it's authority? No law any where in the world can be a law if no-one accepts it as such. FOR THE LOVE OF GOD IGNORE THIS CLOWN AND KICK THE LESBIANS ALL THE WAY OUT OF THE STATE AND COUNTRY IF POSSIBLE. There's no equal representation no jury of piers nothing don't see that as legal and besides no court has power over the house of GOD. It is the duty of the congregation to put a stop to this.

    No court in this country, or anywhere on this planet, has the authority to demand that religious people betray their principles.

    And L.C. is correct.
    The so-called 'Marriage License' is a concept of government, not a requirement to state your commitment to your Wife / Husband in front of GOD.
    It is basically a document in which the government acknowledges a legal partnership…and a pretty good revenue raiser for them also.
    I think people of faith should boycott buying a marriage license as a means to send a message.

The ACLU, dispite its title is nothing of the sort . By siding with one , they violate the civil liberties of the other . Just like a well know world organization headquartered in New York City , they are worthless !

  16. Christians are weak because they believe in government and then complain when that government turns against them. Where in the bible does it say that we should marry people as agents of the state? If the church did not get a licence from the government to marry people, it would not be in this predicament. Any church that receives a licence from the state to marry anyone (gays, straight or otherwise) has submitted itself to the authority of the state rather than the authority of Christ.

    It is the church that violated the principle of separation of church and state. Instead of complaining about persecutions, here is an idea – stop acting as an agent of the state. Do not marry anyone under the authority of man made law. Marry them in the name of Jesus and show the world what you really believe in.

    Every Christian-based church I know of takes it's guidance for policy from the Bible and most folks know what happened to Sodom & Gomorrha – not a pretty picture and we do NOT want that happening to America. Those with conscientious objections to war are permitted to be free from serving in the military. It seems to me that churches which understand the Bible to declare that civil unions between same gender partners are what God hates and refers to as being abomination should never be compelled by the government to violate their inherent belief systems by performing such a ceremony which is a mere mockery of true marriage the way that societal construct was initially begun by the Creator. What demonic arrogance on their part!

  28. Where do you find that a church is licensed by the state to marry folks? I am a minister licensed by the church, not by the state, to marry people, and I marry them in the name of Jesus, not of man. I do not act as an agent of ANY government. Yes, a license is required to be recognized by the state (except in the case of common law marriage), but is not required by the church.

  30. This is what I found with respect to NJ:

    "[various government officials] and every minister of every religion, are hereby authorized to solemnize marriage between such persons as may lawfully enter into the matrimonial relation; and every religious society, institution or organization in this State may join together in marriage such persons according to the rules and customs of the society, institution or organization." It is a misdemeanor for someone not so authorized to "solemnize" a marriage and it is a misdemeanor for someone who is authorized to perform a marriage without the presentation of a license.     So, the authority to perform the marriage is arises from the law, even if you yourself did not get a licence. That is the point. No church should let the government get involved in performing a marriage ceremony. If you wish to call it a common law marriage – so be it.

  31. This is how the gay community has been chipping away at our rights for the past 40 years. First they tried the catholic church with demanding that they go against their religious tenets and provide birth control, contraceptives, abortions etc. That backfired. Now they are trying to force a church to go against its religious tenets and marry a couple of lesbians. WHY are these lesbians demanding to be married in a church? The "church" according to the gay community is homophobic. These lesbians could be married in a civil service at a city office, a rented venue, or someone's backyard…but NOOOOO…they want to force the church to bend so that the !st Amendment of the Constitution is weakened. Once this starts to happen…bye bye 1st Amendment and the rest of the amendments will start becoming meaningless too. This church needs everyone's support!

  32. Because the gay community wants to continue its fight against the Constitution. The catholic church stood up for itself, other churches are much weaker. The gays and progressives prefer to attack the weak so they can set a precedent for bigger and better prizes later. They overestimated themselves when they went after the catholic church. They're just backing down so they can work their way back up. Once the Vatican falls, it's over.

They will try to harm you physically, mentally and financially….and they talk about "gay bashing". Please. The gay community makes up less than 2% of the population, but they are forcing the rest of us to do as they say.
